Terms of Service

1. Acceptance of Terms

By accessing or using GlucoSensei (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and GlucoSensei ("we", "our", "us").

2. Eligibility

You must be at least 18 years old to use GlucoSensei. By using the Service, you represent and warrant that you meet this requirement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Description of Service

GlucoSensei is a personal wellness application that helps users with Type 2 diabetes, prediabetes, or general health interests track their food intake and blood glucose levels, and receive AI-generated insights about the relationship between their diet and glucose response.

The Service includes:

• Manual and AI-assisted food and meal logging
• Blood glucose reading logging and visualization
• AI-generated dietary insights and glucose predictions (powered by Claude, Anthropic's AI)
• Simulated CGM (Continuous Glucose Monitor) data for educational purposes
• Weekly summaries and trend analysis

4. Not Medical Advice

GlucoSensei is not a medical device and does not provide medical advice.

• AI-generated insights, glucose predictions, and food impact rankings are estimates based on patterns in your logged data. They may be inaccurate and should not be used to make medical or treatment decisions.
• The estimated A1C calculation in the Summary view is an approximation based on average glucose readings and is not equivalent to a clinical HbA1c blood test.
• Simulated CGM data is for informational and educational purposes only and does not reflect actual real-time blood glucose readings from a medical device.
• Nothing in this app should be construed as instruction to change your medication, insulin dosing, or medical treatment plan.

You acknowledge and agree that you use all health-related features of the Service at your own risk and that we are not liable for any health decisions made based on information provided by the app.

5. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and complete information when creating your account
• Keep your password secure and not share it with others
• Notify us immediately at support@glucosensei.com if you suspect unauthorized access to your account
• Not create multiple accounts to circumvent restrictions or rate limits

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Impersonate any person or entity
• Attempt to gain unauthorized access to our systems or other users' accounts
• Transmit any malware, viruses, or malicious code
• Interfere with or disrupt the integrity or performance of the Service
• Scrape, crawl, or extract data from the Service in an automated manner without our written consent
• Attempt to reverse-engineer any part of the Service
• Use the Service for any commercial purpose without our prior written consent

7. Your Data

You retain ownership of all health data, meal logs, and glucose readings you enter into GlucoSensei. By using the Service, you grant us a limited, non-exclusive license to store, process, and use your data solely for the purpose of providing the Service to you.

You may delete your data at any time from Settings → Your Data → Clear All Data. For full account deletion, contact privacy@glucosensei.com. See our Privacy Policy for full details on how your data is handled.

8. AI-Generated Content

GlucoSensei uses third-party AI (Anthropic's Claude) to generate insights, predictions, and meal analyses. You acknowledge that:

• AI-generated content may be inaccurate, incomplete, or outdated
• Meal photo analysis is an estimate; actual nutritional content of food may vary significantly from AI estimates
• Glucose predictions are probabilistic and based on limited data. They are not medically validated forecasts
• You should always verify important health information with your healthcare provider

9. Intellectual Property

The GlucoSensei app, including its design, code, branding, and content (excluding your personal data), is owned by GlucoSensei and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written permission.

10. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. WE ARE NOT RESPONSIBLE FOR ANY HEALTH OUTCOMES RESULTING FROM USE OF THE APP OR RELIANCE ON ANY INFORMATION IT PROVIDES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL GLUCOSENSEI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO USE THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless GlucoSensei and its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Service. You may also terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

13. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top and notify you by email or in-app notice. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.
